Types of Users
In these Terms:
“The User,” “You,” and “Your” refer to the person, company, or organization (including any employee of such company or organization) that has visited or is using the Site and/or the Service. Depending on the context within these Terms, a User may be a Client, Consultant, both, or neither.
“Consultant” refers to users of the Platform, whether individuals or businesses, who offer freelance marketing services to Clients (“Consulting Services”). Consultants are not considered employees or agents of EcomVista Enterprises LLC.
“Client” refers to users of the Platform, whether individuals or businesses, who request and/or purchase Consulting Services from a Consultant.
Independent Contractor Status
The relationship between the Consultant and the Client is that of an independent contractor and not an employer-employee relationship. Consultants are solely responsible for determining the method, details, and means of providing the Consulting Services as defined in the Proposal. Consultants are also responsible for withholding taxes on compensation received under a Proposal.
Payment Terms and Transactions
Payment Process: Payment for Consulting Services will be processed as per the schedule outlined in the Proposal and the Proposal Terms. EcomVista Enterprises LLC reserves the right to charge the Client’s credit card, bank account, or PayPal account for the full agreed-upon fee, plus any applicable processing fees. Changes to pricing or payment terms will take effect in the billing cycle following notice of such changes.
Payment Information and Taxes: The Client must provide accurate, complete, and current information for any purchase or transaction. The Client agrees to pay all charges incurred using their chosen payment method, including applicable taxes.
Responsibility for Payment: The Client is responsible for all fees, including taxes, related to their use of the Service. The Client must maintain up-to-date payment information on file with EcomVista Enterprises LLC.
Notification of Payment: EcomVista Enterprises LLC will email the Client a receipt upon charging their card. Failure to update card information may result in the suspension of access to the Services, and EcomVista Enterprises LLC may terminate a Client’s Account for non-payment.
Chargebacks: In case of payment disputes, the Client should contact our billing department. Chargebacks may lead to the termination of the Client’s Account.
Consultants
Consultants are independent professionals offering Consulting Services to potential Clients. They are not employees of EcomVista Enterprises LLC.
Consultant Responsibilities: Consultants must ensure that all information posted on the Platform complies with applicable laws. They are responsible for holding appropriate rights and licenses for all work provided to a Client.
Payments to Consultants: EcomVista Enterprises LLC facilitates payments from Clients to Consultants through a third-party payment provider. Consultants set the price for their Consulting Services and consider the transaction fee. Consultants are responsible for keeping their Accounts and profiles updated.

Dispute Resolution
